SIJS – Securing Immigrant Children Under 21: Success Stories

At our firm, we have successfully helped young clients from countries such as El Salvador, Guatemala, Honduras, Venezuela, Poland, Belarus, Mexico, Tajikistan, Dominican Republic, Uzbekistan, South Korea, and Russia navigate the SIJS process. Our experience has shown that securing SIJS status for kids who have been abandoned, neglected or abused by at least one parent can be life-changing. Below are a few of the success stories we’ve had the privilege of being a part of.

Our firm has extensive experience working with Family Courts in Manhattan, Brooklyn, Bronx, Queens, and Staten Island, as well as courts across New York State, such as Sullivan and Orange counties.. This experience allows us to expedite cases for the youth close to turning 21, anticipate challenges, and secure the best possible outcomes for young immigrants in need of protection.

Trauma to Hope: A Young Immigrant’s Journey

Jose, a brave young immigrant, fled a life of abuse in Honduras. At just 15, Jose endured excessive corporal punishment from his father, who forced him to work in the fields instead of attending school. His mother, fearful of her husband, couldn’t intervene. The trauma led to depression, but Jose found the courage to escape to New York to live with his uncle.

Our team stepped in, helping Jose secure Special Immigrant Juvenile Status (SIJS). He’s now on the path to a brighter future, awaiting his Green Card application. Jose’s story is a testament to resilience and the power of support. We’re honored to have played a part in his journey towards healing, education, and a life free from fear.

Maria’s Story: Overcoming Abuse and Finding Stability

Maria grew up in an abusive home in Guatemala. At age 7, her parents brought her to the United States, hoping for a better life. Unfortunately, the abuse continued. Maria’s father inflicted physical abuse on her and also subjected her mother to domestic violence. Maria qualified for SIJS because of the abuse and neglect from her father.

However, time was of the essence. Maria was almost 21 when she retained our law firm. We succeeded in expediting her hearings in Brooklyn Family Court, where waiting times are typically long. Thanks to our efforts, Maria’s SIJS case was approved by USCIS in just 4 months. Maria is now able to build a stable future, free from the constant fear of deportation.

Juan’s Case: Constructive Abandonment and Family Court Approval

Juan, a 5-year-old from El Salvador, was not abandoned by his parents, but tragically, his father was murdered. In New York, the death of a parent is considered “constructive abandonment.” We argued in the Bronx Family Court that Juan had no relatives in his home country to care for him, and it would be in his best interests to remain in the United States.

Based on the Family Court’s order, USCIS approved Juan’s case. This decision gave Juan the opportunity to stay in the U.S., ensuring a brighter future in a safe and stable environment.
