Stuck in USCIS Delays? An Ombudsman USCIS Request May Help

Waiting on USCIS to process your immigration case can be frustrating—especially when it feels like your application has been forgotten. Processing delays, lost documents, and unresponsive agencies can leave you feeling powerless and uncertain about your future.

At Solovyova Law Firm, we understand how difficult this process can be. You’ve done everything right, but now your case is stuck. That’s where we step in.  Sometimes one of the most effective ways we help our clients overcome USCIS delays is by filing a USCIS Ombudsman request—a powerful tool to get your case moving again.

What Is the USCIS Ombudsman, and How Can It Help?

The USCIS Ombudsman is an independent office that helps individuals with unresolved immigration issues. While they don’t make decisions on cases, they can step in when USCIS is unresponsive—especially when delays impact green cards, work permits, or other critical immigration benefits. If you’ve tried contacting USCIS without success and your application has been pending beyond normal case processing times, the Ombudsman can apply pressure and push for a resolution.

A Real Story: How We Helped a Family Get Their Green Cards

In August 2024, a client came to us concerned that green card petitions for herself and her children had been pending with USCIS beyond normal processing times, but they never received the approval notices or physical cards. We diligently researched what had happened in their case, made several phone calls to USCIS, and made multiple online inquiries. Despite all our efforts to communicate with USCIS directly, they would not provide any information or send the documents to our clients. This case was in limbo for two years.

Our next course of action was to contact the USCIS Ombudsman to request their assistance in ensuring our clients received the documents they had been promised. Ombudsman requests require us to exhaust other options, so it was crucial that we had contacted USCIS several times and saved all the communication records from those inquiries. We provided all these records to the Ombudsman and detailed all the efforts made by us and our clients and the years they had spent waiting for USCIS to send their documents to the correct address.

Processing these requests with the Ombudsman does take a while as they have to prioritize certain types of cases, but about 30 days after we sent the initial request for assistance, they reached out to ask for additional information. We provided the documents the Ombudsman needed and heard back about a month later that they had made contact with USCIS and were waiting for them to respond. Finally, a month after that update, USCIS agreed to send our clients their documents.

A Family’s Future Secured

Now, our client and her children have their green cards and can live and work in the United States without worrying that they do not have proper proof of their legal status here. We know that when people reach out to us for help, the most important thing is to make sure they are heard and receive the help they need. When USCIS is not listening to you, rest assured that we are, and we will do everything we can to make sure they hear you.
